Two separate issues: the divorce and the children

In England and Wales the divorce process ends the legal marriage. Since the no-fault reforms, the application does not involve blame and does not deal with children or money. Arrangements for your children, and any financial settlement, are handled separately and on their own timetable.

What the divorce application involves

• Confirm you have been married at least one year and the marriage has broken down irretrievably
• Provide your details, your spouse's details and your marriage certificate information
• Apply alone (sole) or together with your spouse (joint)
• Wait the 20-week reflection period, then apply for the Conditional Order and later the Final Order

Sorting arrangements for your children

Most separated parents agree arrangements between themselves without going to court. Writing them down helps everyone stay consistent, especially around school terms, holidays and handovers. If agreement is not possible, or there are safety concerns, a court application may be needed.
