Divorce and child arrangements

These are two different processes. The divorce ends your marriage. Child arrangements set out where your children live and how they spend time with each parent, and they are agreed between parents unless the court has to be asked to decide.

CalmSplit handles the divorce for a one-off £159, and offers a separate £95 service if you want a written parenting agreement or help preparing a Form C100 court application.

What the divorce deals with

The divorce application confirms the marriage has broken down irretrievably and moves through the Conditional Order and Final Order. It does not decide arrangements for children and does not divide finances.

What child arrangements deal with

  • Where the children live day to day
  • How and when they spend time with the other parent
  • Holidays, birthdays, school events and handover logistics
  • How decisions such as schooling and medical care are made

Do it in whichever order suits you

There is no legal requirement to settle arrangements before applying for the divorce, or to divorce before agreeing arrangements. Many people do both at once, which often shortens the overall process.

Frequently asked questions

Under the current no-fault process the divorce application does not deal with children at all.
