What makes protection more likely

  • The inheritance was received recently and kept in a separate account
  • It was never used for family purposes such as the family home
  • There are enough other assets to meet both households' needs
  • The marriage was relatively short

What weakens protection

  • The money was mixed into the family home or joint savings
  • It funded the family's standard of living over many years
  • Needs, particularly housing for children, cannot be met otherwise

Future inheritances

A possible future inheritance is generally not treated as an asset because it is not certain. It can still be relevant background where it is expected imminently. This is an area where independent advice is worthwhile.

Two separate processes

It helps to keep two things apart. Ending your marriage is a court process that follows a fixed timetable and does not look at your finances. Sorting your finances is about who keeps what: the home, savings, pensions and debts. You can run them side by side, but one does not automatically decide the other.

Consider independent legal or financial advice where there are pensions of real value, a business, complex property, significant debts, or where you are unsure whether what you have agreed is reasonable. CalmSplit can refer you to an independent solicitor. That does not change your £159 CalmSplit fee, and we do not take a fee for the referral.
