Yes. The sale of your house has nothing to do with the divorce timetable. You can apply for and complete the divorce while the property is still on the market, or before it is even listed.

CalmSplit handles the divorce itself for a one-off £159 per person, so the sale can take as long as it takes. Your agreement about the proceeds is recorded separately, normally in a consent order.

Two separate processes

It helps to keep two things apart. Ending your marriage is a court process that follows a fixed timetable and does not look at your finances. Sorting your finances is about who keeps what: the home, savings, pensions and debts. You can run them side by side, but one does not automatically decide the other.

How people usually handle it

  • Start the divorce now, since it takes at least 26 weeks
  • Market the property and agree how the net proceeds will be split
  • Have a consent order approved that sets out the sale and the division
  • Complete the sale and apply for the final order

While the house is still jointly owned

  • Both of you remain liable for the mortgage
  • Agree in writing who pays the mortgage, bills and any repairs meanwhile
  • Agree how the asking price and any offers will be decided

When to get advice

Consider independent legal or financial advice where there are pensions of real value, a business, complex property, significant debts, or where you are unsure whether what you have agreed is reasonable. CalmSplit can refer you to an independent solicitor. That does not change your £159 CalmSplit fee, and we do not take a fee for the referral.
