Why the two run separately

The divorce ends the marriage. Dividing property is a separate financial process. They can overlap, and often do, because a sale can take months while the divorce follows its statutory timetable.

One thing worth being careful about

Ending the marriage without a financial order means financial claims between you can remain open, sometimes for many years. Most people agree a settlement and record it in a consent order, which the court approves, before or shortly after the Final Order.

Providing for a later sale

  • Set out who lives in the property and who pays the mortgage meanwhile
  • Define the trigger for sale, such as a date or a child finishing school
  • State how net proceeds are divided
  • Cover valuation, estate agent choice and how disagreements are broken
