What if my spouse ignores the divorce papers?
Ignoring the papers does not stop the divorce. It creates a delay while you prove service, after which the court can allow the divorce to continue without your spouse taking part.

After the application is issued, your spouse is sent a copy and asked to acknowledge it, usually within 14 days. If they do not, the case pauses until service is established another way.
Your options
- Court bailiff service, where a bailiff hands the papers over personally
- Process server, a private alternative to the bailiff
- Deemed service, where you can prove the papers reached them
- Alternative service by email, message or via a third party, with permission
After service is proved
The divorce proceeds through the Conditional Order and Final Order in the normal way. Your spouse's participation is not required.
