Separation has no formal legal step in England and Wales. You are separated when you decide the relationship is over, so the practical work is agreeing living arrangements, money and time with children.

Separation agreement or wait?

A separation agreement is not automatically binding but carries weight and can be converted into a consent order once divorce proceedings start. It is useful if you will be separated for a while.

Moving on to divorce

There is no minimum separation period. You can apply for divorce as soon as you have been married a year and you accept the marriage has broken down.
