Decide these four things between you
- Sole or joint application, and who pays the £628 court fee
- How you will divide property, savings and pensions
- Whether to apply for a consent order to make that division binding
- Arrangements for any children, ideally in writing
Agreement is not the same as a binding order
Agreeing between yourselves has no legal force on its own. To close off future financial claims you need the court to seal a consent order. It is a paperwork exercise for couples who agree, and costs a £53 court fee plus the cost of preparing the order.
