Usually yes, if no financial order was made, because there is no strict time limit for most claims. Long delay does not make a claim impossible, though it does affect how a court would deal with it. Remarriage by the person claiming can bar certain claims.

Why time alone does not close claims

Financial claims arising from marriage are ended by a court order, not by the passage of time. Cases have been brought many years after a divorce where nothing was ever finalised.

What reduces the risk

  • A consent order with a clean break, ideally at the time of the divorce
  • Full disclosure at the time, so the order cannot be challenged later
  • Keeping the sealed court order with your important documents

Two separate processes

It helps to keep two things apart. Ending your marriage is a court process that follows a fixed timetable and does not look at your finances. Sorting your finances is about who keeps what: the home, savings, pensions and debts. You can run them side by side, but one does not automatically decide the other.
