Can I remarry after divorce?

Written by CalmSplit Editorial TeamReviewed by Ramani GillLast reviewed 13 August 2026England & Wales

Yes, once the Final Order has been granted. Until then you are still legally married and cannot remarry. There is no waiting period after the Final Order.

CalmSplit takes you through to the Final Order for a one-off £159, and can prepare a consent order so your finances are settled before you remarry.

  • The Final Order is what allows remarriage
  • No waiting period applies once it is granted
  • Settle finances before remarrying, ideally by court order

The order that matters

The Conditional Order does not end the marriage. Only the Final Order does. You can apply for it six weeks and one day after the Conditional Order.

Sort the finances first

Remarrying can affect your ability to make certain financial claims arising from your previous marriage. Most people put a consent order or clean break order in place before remarrying.

What the registrar will want

  • Your Final Order as proof the previous marriage has ended
  • Identity documents in your current name
  • Notice given at the register office in the usual way

Frequently asked questions

No. You remain married until the Final Order is granted.
